Altman stated that OpenAl will appeal against the New York Times' request to retain all user chat data

According to a statement from OpenAl's website, the New York Times is requesting the court to compel OpenAl to "indefinitely" retain all chat records and API customer content of all ChatGPT users in its lawsuit. In response, CEO Sam Altman stated that this move "seriously deviates from the user privacy promise" and emphasized that the company has filed an appeal and will "strongly oppose any request that damages user privacy." OpenAl stated that the affected users are non-corporate class ChatGPT and API users who have not signed a "zero data retention" agreement, and the data will be encrypted and only accessible to the legal team.
