Odaily Planet Daily reports that Coinbase Chief Legal Officer Paul Grewal posted on the X platform: "Through a Freedom of Information Act (FOIA) lawsuit, we have obtained more details from the U.S. Securities and Exchange Commission (SEC) regarding the Gensler-era investigation into Ethereum 2.0 (ETH2.0). The following documents were found in their Vaugh index of unreleased materials, and we intend to investigate further:
- A May 2022 PDF titled 'Analysis of Ethereum 2.0 under the Howey Test,' prepared by SEC staff.
- An email from February 2023 titled 'Response Regarding Whether Ethereum is a Security.'
- An April 2023 PDF titled '2 - Ethereum 2.0,' which may be the memorandum received by commissioners before voting to authorize the investigation into Ethereum 2.0.
- An August 2023 email titled 'Timing for Discussions on Ethereum.'
- Two emails from February 2024 titled 'FW Spot Ethereum—Security or Non-Security' and 'Ethereum—Security or Non-Security,' respectively.
- Emails from February and April 2024 and their attachments discussing 'Possible Approaches to Specific Legal Issues Related to Ethereum.'
