The lawsuit centers on whether the funds held by 3AC were in trust for Defiance Capital or owned by 3AC. Defiance Capital, founded by Cheong Jun Yoong (Arthur Cheong), claims that its investors were the ultimate beneficial owners of assets held in trust by 3AC, and these funds should not be used to satisfy creditor claims against 3AC. The court found that the crypto in the Fireblocks wallets, still under 3AC control, was in trust, despite 3AC's counterclaims. This decision highlights the treatment of crypto assets and trust relationships in legal disputes. Additionally, the court deemed Singapore the appropriate forum for the suit, given the significant connection to the country.
